Terms & Conditions
Quotations / Orders are subject to the terms and conditions below not withstanding any conditions of the customer unless accepted by Shabra Plastics and Packaging in writing.
1.0 Validation of Quotations:
All quotations are valid for a maximum of 14 days from date on quotation. Delivery charges are not included in any quotation and will be charged upon “Checkout” of order.
2.0 Prices
All prices quoted are correct at 30th October 2013. Shabra reserve the right to amend prices due to currency fluctuation, raw material or other cost increases. All prices are quoted exclusive of VAT, and the customer is liable to incur this charge
3.0 Payment
Full payment for goods on order and delivery charge must be made before Shabra will dispatch any goods for delivery unless written agreement is made between Shabra and Client.
4.0 Delivery
Delivery dates are given by Shabra as accurately as possible and are not subject of any warranty or guarantee. Shabra will accept no responsibility if delivery dates are not met for any reason whatsoever.
It is the responsibility of the Client to notify Shabra of any non deliveries within 5 working days and please confirm same in writing.
If any goods are damaged or short delivered it is also the responsibility of the Client to notify Shabra immediately and confirm same in writing.
5.0 Returns
Should the Client wish to return an item we will be happy to issue a refund or exchange the goods for alternative products as long as the goods to be returned are done so in full re-saleable condition.
Goods should be returned in original undamaged packaging and within a reasonable amount of time i.e. 10 working days
Please note that there may be a collection charge for goods returned.
Shabra will not accept any goods returned unless an agreement has been made with the Client.
6.0 Reservation of Title
Ownership of the goods will only pass to the Client once Shabra has received all monies in full and any other monies due regardless of whether the goods have been delivered.
7.0 Risk
The risk of the goods will pass to the Client upon delivery or sooner when possession of the goods is taken by the carrier for delivery to the Client.
8.0 Force Majeure
The company shall not be liable to the customer, or deemed to be in breach of any contract with the Client, by reason of any delay in performing, or any failure to perform, any of Shabra’s obligations in relation to the goods. If the delay or failure was due to force majeure, or to any other cause beyond Shabra’s reasonable control.
9.0 Applicable Law
These conditions shall be governed by and construed in accordance with Irish Law and Jurisdiction.
